The Criminal Code and the Highway Safety Code contain several provisions governing impaired driving. Depending on the circumstances surrounding the event, the peace officer will have to adapt his intervention according to the specific powers conferred on him by the various laws.

This intervention will vary based on the application of provisions found in the Criminal Code or the Highway Safety Code. It is such particularly if the peace officer has reason to suspect that alcohol or drugs are present in the body, or if there is reason to believe that an offence against the Criminal Code has been committed in this way.
